Purchase Terms and Conditions

PLEASE READ THESE TERMS CAREFULLY AND IN FULL. THEY CONTAIN IMPORTANT CONDITIONS AND RESTRICTIONS ON THE AVAILABILITY OF COURSE CONTENT ON SPOTIFY.

Please read these Purchase Terms and Conditions (these "Purchase Terms") carefully as they govern your use of (which includes access to) any educational, training or learning courses, content or materials ("Course Content") on the Spotify Service (as that term is defined in the Spotify Terms of Use, which are hereby incorporated by reference). Capitalized terms used but not defined herein shall have the same meaning given to them in the Spotify Terms of Use. For the avoidance of doubt, the Course Content is deemed "Content," for the purpose of applying the Spotify Terms of Use to these Purchase Terms. In the event of a conflict between these Purchase Terms and the Spotify Terms of Use, the Purchase Terms shall govern.

By clicking 'Buy', 'Purchase Now', or otherwise using or Accessing Course Content on the Spotify Service, you agree to these Purchase Terms and the Spotify Terms of Use. If you do not agree to these Purchase Terms and the Spotify Terms of Use, then you must not use the Spotify Service or access any Course Content.

  1. Course Content

(a) Availability of Course Content

(i) You acknowledge that certain Course Content may not be available to you for reasons including but not limited to the following: based on your location and jurisdiction; if you do not meet applicable age requirements; due to relevant laws and regulatory requirements; if we need to make modifications, improvements or updates to the Course Content; or if we determine that you are in breach of these Purchase Terms, the Spotify Terms of Use or any other applicable policies.

(b) Use of Course Content

(i) You must have a Spotify account to use all or part of the Spotify Service. From time to time, you may be required to update the Spotify Service or the operating system on your Device to access the Course Content. Failure to do so may mean that the Course Content is not available to you. For more information about updating the Spotify Service or the operating system on your Device, please refer to this support article. To Access the Course Content, you may be required to make a purchase even if your account on Spotify is a Paid Subscription or you have a free-of-charge or other promotional membership or plan on Spotify.

(ii) Unless otherwise provided, the Course Content is compatible and/or interoperable with the third party applications and devices listed in this support article.

(iii) You may only Access the Course Content through the Spotify Service or a Third-Party Application or Device. If you'd like to listen to the Course Content on a particular Third-Party Application or Device, please check compatibility with the Spotify Service before making a purchase.

(iv) Subject to these Purchase Terms, when you purchase or are otherwise granted Access to Course Content, Spotify grants you a revocable, limited, non-exclusive right to Access the Course Content solely for your personal, non-commercial use for as long as you have an account to the Spotify Service. You acknowledge that Access to the Course Content can be revoked by Spotify in accordance with the terms of Section 1(c) of these Purchase Terms.

(v) You acknowledge that we are granting you the right to Access the Course Content and that such Course Content is not sold or transferred to you and that Spotify and/or its licensors retain ownership of the Course Content even after you purchase or otherwise access the Course Content.

(c) Access Revocation

(i) We reserve the right to revoke your right to Access the Course Content including for the following reasons: (A) a valid legal claim or order; (B) if the Course Content violates applicable law, our terms or policies, or the proprietary rights of any third party; (C) your violation of these Purchase Terms, the Spotify Terms of Use, or any other applicable terms or policies; (D) pursuant to Section 2(d) below; (E) if we suspend or terminate all or part of the Spotify Service or otherwise make changes to the Spotify Service pursuant to Section 2 of the Spotify Terms of Use; or (F) your payment for the Course Content is not successful.

(ii) If we exercise our right to revoke your right to Access the Course Content pursuant to these Purchase Terms, the Course Content may no longer be available to you through the Spotify Service. In such cases, we may provide you with a full or partial refund where we are legally obliged to do so or pursuant to Section 2(b) below.

  1. Purchases and Returns

(a) Discounts

(i) Spotify may offer discounts or promotions with respect to the Course Content. Such discount or promotion may not be retroactively applicable to your previous purchase or download. We may also make Course Content that you have already purchased available for free in the future.

(b) Refunds and Withdrawal Right

(i) In certain cases, we may offer refunds for Course Content that you have already paid to Access. In such cases, you may request a refund by contacting Customer Support. The applicable refund policy for each work of Course Content will be specified on our Customer Support page when you pay to Access that Course Content. You acknowledge that a refund may not be available in all cases and that we may change our refund policy at any time. Our refund policy does not limit your rights to claim a refund under any applicable law.

(ii) All refunds will be credited to the original form of payment.

(iii) Unless otherwise required by law, we reserve the right to monitor refund requests for any abuse, such as excessive requests, frequent requests for refunds of Course Content after substantial listening, or multiple successive refund requests. In instances where we find refund privileges are being misused, we reserve the right, where permitted under applicable law, to limit the number of refunds you may request or that we honour, including, but not limited to, the loss of refund privileges.

(iv) When you purchase Course Content, you expressly:

(1) consent to us providing you with the Course Content immediately following your purchase; and

(2) acknowledge that you lose your right of withdrawal when the provision of the Course Content begins and you authorize us to charge you for the purchase at the same time.

(c) Taxes

(i) Spotify may charge taxes on any purchase of Course Content. Tax rates are calculated based on the information you provide and the rates applicable at the time you are charged. These amounts can change over time with local tax requirements in your country, state, territory, county, or city.

(d) Price Correction

(i) Spotify reserves the right to modify or update the displayed price for the Course Content at any time, including due to an erroneous price being displayed.
